Remember these documents are time sensitive and you only have a short window of time to respond depending on your state’s rules and foreclosure laws, so call your lawyer immediately if you have been served with any legal documentation or any notices from your lender of their intent to foreclose.
The fees that foreclosure defense attorneys charge vary from $500.00 -$750.00 to a sum equal to one or two months of your mortgage payment. Ask the attorney what the fee is, and how long it will take to defend you and what the defense entails.
Ask your attorney to review your loan documents to make sure that there have not been any predatory loan practices or fraud. If there has been predatory loan practices or fraud, then your attorney can use that as a defense to rescind your loan, or just as a bargaining chip to help get the foreclosure action against you dismissed and resolve the issue with your lender to prevent you from losing your home.
HUD Certified Home Counselors
For a list of certified home counselors in your area, you can visit the HUD website. Although the services are free, the housing counselors may have a limitation as to what kind of help they can give you since they are not attorneys and cannot defend you in any legal actions as discussed in the paragraph above.
Mortgage Broker, Other Businesses and Mortgage Modification Companies
If you decide to discuss your options with your mortgage broker, or another business that specializes in stopping foreclosures such as a mortgage modification company, be aware again that they have limitations as to how much they can help you because legally they cannot defend you. Some companies charge a fee upfront, which is illegal in many states, so check with the better business bureau and your state statutes to make sure that the company is conducting legal business practices.
